These Terms & Conditions (the “Terms”) govern your access to and use of the Farming is Life website located at https://www.farmingislife.org and any related webpages (the “Site”), as well as in‑store and online purchases from The Farm Stand, located at 244 School Street, Winchendon, Massachusetts 01475 (collectively, “Farming is Life,” “The Farm Stand,” “we,” “us,” or “our”). By visiting the Site, shopping in store, or making a purchase through any of our channels, you (“you” or “Customer”) agree to be bound by these Terms and by our Privacy Policy, which is incorporated herein by reference. If you do not accept these Terms, please do not use the Site or purchase our products.
1. Definitions
- “Site” – the Farming is Life website and any services, content, or functionality offered through it.
- “Store” – The Farm Stand retail grocery store at 244 School Street, Winchendon, MA.
- “Products” – all goods offered for sale by us, including produce, packaged foods, bulk items, beer, and wine.
- “Age‑Restricted Products” – beer and wine or any other items that require buyers to be at least 21 years of age under applicable law.
2. Acceptance of Terms
By accessing the Site, creating an account, placing an order online or in store, or otherwise engaging with us, you affirm that you have read, understood, and agree to these Terms. If you are using our services on behalf of an organization, you represent that you have authority to bind that organization, and “you” includes that organization.
3. Eligibility & Age Restrictions
- Minimum Age for the Site. The Site is intended for individuals 18 years of age or older. If you are under 18, you may browse the Site only with the involvement of a parent or guardian.
- Alcohol Sales. In compliance with Massachusetts General Laws c.138 and 204 CMR 2.00, the sale of beer and wine is restricted to persons 21 years of age or older. A valid, government‑issued photo ID must be presented every time Age‑Restricted Products are purchased, picked up, or delivered. We reserve the right to refuse or cancel any order when acceptable identification is not provided.
4. Product Information & Availability
We strive to display product descriptions, images, pricing, and availability accurately; however, accidental errors or omissions may occur. We reserve the right to correct any errors and to change or update information at any time without prior notice, including after you have submitted an order. All Products are subject to availability, and we may limit quantities at our discretion.
5. Pricing, Taxes, and Payment
- Pricing. Prices listed on the Site or in store are in U.S. Dollars and are subject to change without notice.
- Sales Tax. Applicable Massachusetts sales tax (currently 6.25 % on taxable goods such as prepared foods, beer, and wine) will be added at checkout. Most staple grocery items (e.g., unprepared fruits and vegetables) are exempt from Massachusetts sales tax.
- Payment Methods. We accept the payment methods indicated at checkout, which may include cash, credit/debit cards, EBT, and contactless payment systems. Online orders must be paid in full at the time of purchase.
6. Alcohol Sales Policy
- Legal Compliance. Alcohol may only be sold, delivered, or otherwise transferred to persons 21 or older in accordance with our Massachusetts off‑premise retail license (beer & wine). We do not ship alcohol outside Massachusetts.
- ID Verification. Acceptable forms of identification include a valid driver’s license, state identification card, passport, or U.S. military ID. Identification must show date of birth, photo, and must not be expired.
- Refusal of Service. We reserve the right to refuse sale or service to anyone who appears intoxicated, attempts to purchase for a minor, or fails to present valid ID.
- Delivery. If local delivery of alcohol is offered, the recipient must present valid ID at delivery. Deliveries will be refused when ID is not provided or the recipient is under 21.
7. Orders, Pick‑Up, and Delivery
- Order Acceptance. Your order represents an offer to purchase; it is accepted only when we send an order confirmation or provide the goods. We may refuse or cancel orders for any reason, including inaccuracies or suspected fraud.
- Pick‑Up. Orders marked for pick‑up will be held for the timeframe specified in your confirmation. Orders containing Age‑Restricted Products will only be released to the person named on the order after ID verification.
- Delivery Areas. We currently offer local delivery within designated ZIP codes. Delivery fees and minimum order totals may apply. Delivery of Age‑Restricted Products requires ID verification on arrival.
8. Returns & Refunds
- Perishable Items. Due to the nature of fresh produce and other perishables, all sales are generally final. If you are dissatisfied with quality, please contact us within 24 hours and we will, at our discretion, offer replacement or refund.
- Non‑Perishable Items. Unopened, non‑perishable items may be returned within 14 days of purchase with the original receipt for exchange or refund.
- Alcohol. Returns or exchanges of alcohol are limited by Massachusetts law and can only be processed if the product is spoiled, contaminated, or otherwise unfit for consumption.
9. Intellectual Property & Site Content
All content on the Site—including text, graphics, logos, images, audio clips, and software—is the property of Farming is Life, The Farm Stand, or our content suppliers and is protected by U.S. and international copyright, trademark, and other intellectual‑property laws. You may view, print, or download portions of the Site for personal, non‑commercial use only. Any other use, including reproduction, modification, distribution, or republication, without our prior written consent is strictly prohibited.
10. User Conduct & Accounts
You agree not to use the Site or Store for any unlawful purpose or in a manner that could damage, disable, overburden, or impair our systems. If you create an account, you are responsible for maintaining the confidentiality of your credentials and for all activities that occur under your account.
11. Health & Safety Disclaimer
Information provided on the Site regarding nutritional or health benefits is for general informational purposes only and is not a substitute for professional medical advice. Always consult a qualified health provider for guidance specific to your situation.
12. Disclaimer of Warranties
THE SITE, STORE, AND ALL PRODUCTS ARE PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE MAKE NO WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, OR NON‑INFRINGEMENT.
13. Limitation of Liability
To the fullest extent permitted by law, Farming is Life and The Farm Stand will not be liable for any indirect, incidental, special, consequential, or punitive damages arising from or related to your use of the Site, Store, or Products, even if we have been advised of the possibility of such damages. Our total liability to you for any claim arising out of or relating to these Terms or the Products shall not exceed the greater of (a) the amount you paid in the 12 months preceding the claim or (b) fifty U.S. dollars (US $50).
14. Indemnification
You agree to indemnify and hold harmless Farming is Life, The Farm Stand, and our affiliates, owners, employees, and agents from any claims, damages, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising from your breach of these Terms, your misuse of the Site or Products, or your violation of any law or the rights of a third party.
15. Governing Law & Dispute Resolution
These Terms are governed by, and construed in accordance with, the laws of the Commonwealth of Massachusetts, without regard to its conflict‑of‑laws principles. Any dispute arising under these Terms shall be resolved exclusively in the state or federal courts located in Worcester County, Massachusetts, and you consent to personal jurisdiction and venue in those courts.
16. Changes to These Terms
We may update these Terms at any time by posting the revised version on the Site and updating the “Last Updated” date above. Changes are effective immediately upon posting. Your continued use of the Site or Store after changes have been posted constitutes your acceptance of the revised Terms.
